This Court is asked to determine whether the trial court properly granted a summary judgment in a suit against an insurer for violations of the Texas Deceptive Trade Practices Act (DTPA), the Insurance Code, and for breach of the duty of good faith and fair dealing. We find that it did not, and reverse the judgment and remand the cause for a trial on the merits.
